The short version: use this site normally and lawfully. The examples on it are made up and for illustration. Any work we do for you is covered by a separate written agreement, not by this page.
Agreement
These terms apply to your use of newyorkoptimized.com (the "site"), run by New York Optimized ("we", "us"). By using the site, you agree to them. If you don't agree, please don't use the site.
Information on this site
The content here describes our services in general terms. It isn't a binding offer, a quote or professional advice for your situation. Prices, timelines and features for a project are set only in a written proposal or agreement signed by both of us.
Examples and demos
The interactive examples on this site use fictional companies, people and figures. Any resemblance to real businesses or people is coincidental. Private demos we share with you are provided as-is for evaluation, may change or be reset at any time, and may not be shared with others or used for any real business purpose. Please don't enter real personal or customer information into them.
Acceptable use
You agree not to:
- break the law or anyone's rights while using the site;
- try to gain unauthorized access to the site, a demo or our systems, or test their security without our written permission;
- disrupt the site, including by overloading it or sending automated traffic;
- send spam or harmful code through the contact form;
- copy the site's design, code or content for your own commercial use.
Our content
The site's text, design, graphics and code belong to New York Optimized or its licensors and are protected by copyright and other laws. You may view and share links to the site. Anything else requires our written permission. Ownership of software we build for clients is set in each client's agreement. The Inter typeface is used under the SIL Open Font License.
Links to other sites
If we link to another website, we aren't responsible for its content or practices.
No warranties
The site and any demos are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the site will always be available or error-free.
Limit of liability
To the fullest extent the law allows, New York Optimized won't be liable for any indirect, incidental, special or consequential damages, or lost profits or data, arising from your use of the site or demos. Our total liability for any claim about the site is limited to $100. Nothing here limits liability that can't be limited by law.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute about the site will be brought in the state or federal courts located in Monroe County, New York, and you consent to their jurisdiction.
Changes
We may update these terms. The date at the top shows the latest version, and continued use of the site means you accept it.
